CAMPBELL HEAVY HAUL – TERMS & CONDITIONS


These Terms and Conditions govern all transportation services provided by The Campbell Corporation, DBA Campbell Heavy Haul (“Carrier”). By booking or accepting services, the Shipper/Customer agrees to these terms.


1. Services Carrier provides specialized transportation services, including but not limited to lowboy transport, heavy equipment hauling, and end dump trucking. All services are performed subject to applicable federal, state, and local regulations, including oversize/overweight permit requirements.


2. Rates & Payment Rates are quoted on an hourly basis by specific job, depending on load, distance, complexity, and equipment required. Quotes are valid for 14 days from the date of issuance unless otherwise stated. Payment is due upon receipt unless other terms are agreed to in writing. Invoices unpaid after 10 days are subject to a 5% late fee, with additional incremental interest accruing at 1.5% per month (18% APR) thereafter. Customer is responsible for all tolls, permits, escort fees, and accessorial charges unless explicitly included in the quote.


3. Cancellation / No-Show Policy Cancellations must be made at least 24 hours prior to scheduled pickup. Customer is responsible for any costs incurred by Carrier prior to cancellation. Same-day cancellations or no-shows will be billed a minimum of 4 hours at the quoted rate.


4. Cargo Liability & Insurance Carrier maintains $2,000,000 in General Liability and $250,000 in Motor Truck Cargo insurance ($1,000 deductible). Carrier’s liability for cargo loss or damage is limited to the lesser of (a) the actual value of the cargo, (b) $250,000 per shipment, or (c) the limits of Carrier’s insurance policy, whichever is less, unless additional cargo insurance is requested and paid for in advance. Our experienced drivers will load and unload equipment at no additional charge in most cases. For very large or unfamiliar machines, the customer may operate the equipment while our driver provides direction to ensure safe and proper positioning on the trailer. End dump loads are typically performed by the customer or their subcontractor. Customer is responsible for properly securing and bracing all loads and for providing safe access and conditions at the job site.


5. Permits, Escorts & Compliance Customer must provide accurate load dimensions, weight, and origin/destination details. Customer is responsible for any fines or penalties resulting from inaccurate load information.


6. Hazardous Terrain & Off-Road Carrier has extensive experience navigating hazardous terrain, logging roads, and remote job sites. Additional charges may apply for extreme conditions.


7. Force Majeure Carrier is not liable for delays or non-performance caused by acts of God, weather, road closures, strikes, government regulations, or other events beyond reasonable control.


8. Indemnification Customer agrees to indemnify and hold Carrier harmless from any claims, damages, or liabilities arising from inaccurate load information or Customer’s negligence.


9. Governing Law These terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of Amador County, California.


10. Entire Agreement These Terms and Conditions, together with the accepted quote or rate confirmation, constitute the full agreement between the parties. No modifications are valid unless in writing and signed by both parties.
